15-0202 v2.1/Living Aleutian Home/Setback Requirement Question

QUESTION

Can I subtract the property's setback when doing calculations for the agricultural requirement (I02-3)? As in, the actual area we can plant is smaller than the stated square foot of the plot because of the setback requirement.

ANSWER

Generally, a property setback is a restriction on built structures, not landscape elements, therefore it would not reduce the area that a team could plant. If your local jurisdiction defines a property setback or habitat easement in a way that limits planting, the team would need to submit documentation of the restriction and a site plan showing the implication, in order to be considered for a specific case exception.
