We have a question regarding the Imperative 16: Universal access to nature and place. It is said that "Access for those with physical disabilities must be safeguarded through designs meeting the Americans with Disabilities Act (ADA) and Architectural Barriers Act (ABA) Accessibility Guidelines". We would like to ask for an exception.

Boldesti-Scaeni resource center is a construction meant to foster after-school and vocational activities for the poor children of the Romani community in the area. The building is of small dimensions - the gross floor area is of 225 sqm and therefore our space for the toilets is very limited as well. We planned 4 toilets, 2 for men and 2 for women and 4 showers (see in the attached plan). However, none of them is designed for people with physical disabilities. We have chosen to do so because the situation is of a special nature: presently, most of the people from the community lack the comfort of having access to a toilet or a shower (the 1000 Romani inhabitants in Boldesti-Scaeni are very poor, with extremely low living conditions, where the unemployment rate is of approximately 95%). We considered that offering them access to 4 toilets and 4 showers in the Boldesti-Scaeni resource center will considerably improve their comfort and living conditions. In the case in which we would choose to have a toilet for people with physical disabilities and because of the space requirements, the total number of the toilets would decrease to 3 (we would turn the two toilets for women in one for people with disabilities). This would create a problem since the toilets would be frequently and intensively used during the day: there will be daily activities and 30 children will be having lunch there in the same time, plus there will be other people from the community wanting to use the toilets. Providing them with only 3 toilets would be an impediment in the good functioning of the building or in helping the Romani people regarding a very important need.

Having this situation as a context, we would like to ask for an exception in the Imperative 16. We see as a considerable help for the community to provide 4 toilets and 4 showers and less than these would be a loss in this matter. 


Compliance with ADA and ABA Accessibility Guidelines is required. The intent of Imperative 16 Universal Access to Nature & Place is to safeguard access to amenities for all members of the public, including those with physical disabilities who might not be able to use your new facilities if none of them are ADA accessible.
