QUESTION

We were looking at the restrooms provided in our project and they comply with the code requirements but we are looking for a quick clarification from the LBC institute regarding the unisex bathrooms.

Does "equally accessible to all members of the public" mean we have unisex bathroom facilities for transgender or is it ok to have segregated bathrooms? and If we need to have an unisex bathroom, is it ok to have one on the upper level and not on the main level? Please see the attached floor plan for your reference.

It is OK to have segregated bathrooms although you are encouraged to have a unisex bathroom and it is OK to have it on the upper level.
